Welcome to the BIG Caring Group’s Terms of Use (“Terms”). These Terms apply to your use of Medispec and its subsidiaries and the services offered through our Platform. The Platform includes our website(s), mobile application(s), digital health services, pharmacy services, and any programs operated by BIG Caring Group including our affiliates, subsidiaries, and related entities.
Please read these Terms carefully before accessing or using the Platform. By accessing or using any part of the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to all the terms and conditions herein, please do not use the Platform.
1. Scope of Terms
These Terms apply to your access and use of:
• The Medispec and its subsidiaries website(s) and mobile application(s);
• Pharmacy services including prescription fulfillment and medication purchases;
• Digital health services such as e-consultation, telepharmacy, and virtual health assessments;
• Any digital or physical product or service provided through our Platform;
• Promotional campaigns, rewards, or membership programs.
2. Eligibility
You must be at least eighteen (18) years of age, or have the consent of a legal guardian, to access or use the Platform. Certain services-such as prescription medication purchases, or digital health consultations-may require additional verification or be subject to further restrictions imposed by applicable laws.
3. Privacy and Data Protection
Your privacy is extremely important to us. In accordance with the PDPA Amendment 2024, all personal data collected through the Platform is processed in compliance with applicable legal requirements. By using the Platform, you consent to the practices described in our Privacy Policy, including the processing of sensitive and biometric data, and the exercise of your data subject rights such as access, data portability, and the right to be forgotten.
4. Use of the Platform
You agree to use the Platform only for lawful purposes and in accordance with these Terms. You further agree that you shall not:
• Use the Platform in any way that violates applicable laws or regulations;
• Engage in any fraudulent, misleading, or deceptive practices;
• Upload or transmit viruses, malware, or any other malicious code;
• Interfere with or disrupt the security or performance of the Platform;
• Attempt to gain unauthorized access to any part of the Platform or its associated systems.
We reserve the right, at our sole discretion, to restrict or terminate your access if you violate these Terms.
5. Pharmacy and Digital Health Services
Our licensed pharmacists and health professionals provide pharmacy and digital health services in compliance with applicable Malaysian laws and professional guidelines. Prescription medication orders may require validation, and we reserve the right to cancel or reject orders that do not meet legal or professional requirements. Digital health services, including online consultations or symptom assessments, are intended solely for informational purposes and do not replace professional medical diagnosis or treatment.
6. Product and Service Information
All product descriptions, images, pricing, and availability information are for informational purposes only and may change without notice. We do not warrant the accuracy, completeness, or currency of such information. We may cancel or refuse orders in the event of inaccuracies, stock limitations, or suspected misuse.
7. Payment Terms
We accept multiple forms of payment-including credit/debit cards, e-wallets, and online banking (FPX)-with transactions processed in Malaysian Ringgit (MYR). By providing your payment information, you represent that you are authorized to use the designated payment method and approve us to charge the full amount of your purchase. We are not liable for any delays or failures in transaction processing due to payment system issues.
8. Promotions and Campaigns
Promotional offers, discount codes, and reward programs are governed by specific terms and conditions. We reserve the right to modify or cancel any promotion without prior notice, limit quantities or eligibility, and disqualify users found engaging in fraudulent activity. Promotional offers are non-transferable and have no cash value unless explicitly stated otherwise.
9. Membership and Loyalty Programs
Participation in our membership or loyalty programs is subject to eligibility criteria and the specific terms of each program. Rewards and membership points may expire or be forfeited at our discretion. We reserve the right to amend, suspend, or terminate any such program without liability.
10. Fraud and Abuse
We actively monitor Platform transactions and user activities for abusive or fraudulent practices. In cases of suspected misuse, we reserve the right to cancel transactions, suspend or terminate user accounts, and report the matter to relevant authorities.
11. Intellectual Property
All content, design elements, graphics, logos, trademarks, service marks, text, software, and other materials on the Platform are owned or licensed by Medispec and its subsidiaries and are protected by copyright and other intellectual property laws. Reproduction or distribution of any content without our prior written consent is prohibited.
12. Our Obligations
We undertake to:
• Ensure the accuracy of the information provided on the Platform;
• Employ robust security measures to safeguard your personal data in line with PDPA Amendment 2024 requirements;
• Adhere to all applicable legal and professional standards.
Notwithstanding such efforts, we do not guarantee uninterrupted access, absolute accuracy, or complete security of the Platform. For detailed information on our technical security protocols, please refer to our IT department’s dedicated documentation.
13. Representations, Warranties, and Indemnity
We disclaim all warranties-express or implied-including fitness for a particular purpose, merchantability, and non-infringement. You agree to indemnify Medispec and its subsidiaries from any claims arising from your use of the Platform, breach of these Terms, or any violation of applicable laws.
14. Limitation of Liability
To the fullest extent permissible by law, Medispec and its subsidiaries shall not be liable for any indirect, incidental, or consequential damages related to:
• Errors or omissions in the content provided;
• Unauthorized access to your data. Our total liability will not exceed the amount you have paid for a specific service.
15. Force Majeure
We are not responsible for any delays or failures in performance caused by events beyond our reasonable control, including natural disasters, internet outages, government restrictions, labor strikes, or pandemics.

17. Governing Law and Entire Agreement
These Terms are governed by the laws of Malaysia, and any dispute shall be resolved exclusively in the Malaysian courts. If any provision is found to be unenforceable, the remaining provisions will continue in full force and effect. These Terms constitute the entire agreement regarding the use of the Platform. BIG Caring Group reserves the right to revise this document at any time, with changes effective upon posting.

A. Collection of Personal Data
We collect your personal data directly when you interact with our services through registration, loyalty programs, our app, website, consultations, or other official platforms. This data may include, but is not limited to:

Note: Personal data pertaining to deceased individuals is excluded under the PDPA Amendment Act 2024.
